The final rule does not cover exposures to Cr(VI) that occur in the application of pesticides.
Therefore, OSHA specifically excludes those exposures to Cr(VI) resulting from the application of a pesticide regulated by EPA from coverage under the final rule.
The use of wood treated with pesticides containing Cr(VI) is covered. In this respect, the Cr(VI) standard differs from OSHA’s Inorganic Arsenic standard (29 CFR 1910.1018). However, OSHA’s exposure profile indicates that work with wood treated with pesticides containing Cr(VI) can involve Cr(VI) exposures above the new PEL (see FEA, Chapter III).
